Nassau County DWI Wall of Shame: Judge rules politicians unfair

[Update 11/24/2008: Last I recall hearing, Nassau County gave up on the idea of posting everyone stopped (before they were convicted), and now only posts photos after people are convicted. This solves the “innocent until proven guilty” problem and addresses a lot of the concerns.-KW]

Judge rules that a woman’s name should be taken down and that the Wall of Shame is unjust. Yet, Nassau County persists in the Wall of Shame publication, and Newsday persists in supporting Nassau’s injustice. Newsday just won’t quit.

Judge orders Nassau to remove name, photo from “Wall of Shame”

A judge has ordered Nassau County to remove a woman’s name and mug shot from the county’s online “Wall of Shame,” saying that posting the information about her DWI arrest violates her right to due process.

State Supreme Court Judge William LaMarca said posting Alexandra Bursac’s photo punishes her in a way not authorized by the law. And because of the permanence of the Internet, it imposes an inappropriate penalty by exposing her to “limitless and eternal notoriety.”

County Attorney Lorna Goodman said her office will not remove Bursac’s name and photo, or anyone else’s, from the “Wall of Shame.” She said the county will appeal the decision, which will automatically put the judge’s order to remove the name and photo on hold.

  1. This is a Constitutional issue that will in the end only cause more problems than it solves. You can not simply shame people into appropriate behavior.

It’s about time that a judge woke up and made a ruling that a person is intitled to due process..Unlike that idiot cop who arrested Andrea Sangermano because he took it upon himself that he was a doctor and said no your not sick your on drugs, and yet the village of Hempstead lets him work, that’s scary…I hope Andrea Sangermano sues the hell out of the town of Hempstead and their inferior police department and don’t forget that moroon Tom Suozzi, he should step down he’s no good, after watching the statement he made on ch 7 news on 9/12 he’s nothing short of being a jackass, he has no respect for peoples due process
