In a November 8, 2007 Order Federal District Judge Benjamin H. Settle in Tacoma, Washington has issued a preliminary injunction over the court martial of 1st Lt. Ehren Watada for refusing an order to deploy to Iraq and statements he made alleging the war is immoral and illegal. The injunction will stay in force pending further proceedings and the resolution of the double jeopardy issues raised in Watada’s habeas corpus petition. The Judge ruled that Lt Watada “is likely to succeed on the merits of his double jeopardy claim” and “at demonstrating that the military judge acted ‘irrationally, irresponsibly, precipitately’ and abused his ‘discretion’ …”.
