Leaving a candidate’s name off the ballot

Why do I care about a Democratic candidate in New York City Council District 1? Because, a technicality first threw the candidate’s signatures out at the Board of Elections. And, in the tug-of-war, the candidate was put back on the ballot. Though, the Board of Elections sent out the absentee ballots without his name on them. That is wrong. And, the battle over it could create interesting precedents and benefits for third party candidates – who are often forced to fight in the courts to stay on the ballot.

Gerson Not On Absentee Ballot

The absentee ballots for the upcoming Democratic primary contests are starting to arrive in mailboxes throughout the city, and 1st CD voters might notice a glaring omission.

Despite the fact that a state Supreme Court justice restored his name to the ballot last week, incumbent Councilman Alan Gerson’s name is nowhere to be seen…

Gerson’s attorney, Lawrence Mandelker, who forwarded over this sample ballot, told me last Friday he wasn’t yet certain whether he’ll be going to court over this.

Assuming Gerson’s ballot status holds in the face of continuing legal challenges by one of his Democratic opponents, Pete Gleason, the councilman’s name will appear on provisional paper ballots at polling sites in the 1st CD on primary day…

ALAN J GERSON launched an unprecedented number of initiatives including: a new youth swim team, an evening teenage center, a free community mediation facility, a heart defibrillator pilot program, new emergency shelters for homeless (runaway) teenagers, starting work on the Hudson River Waterfront Park, the first Arts Committee and Calendar, a new Public Safety Committee and a Community Court Proposal.
